Code Noir is an independent digital systems studio operated by Dale Barrett in the United Kingdom. Dale Barrett, trading as Code Noir, is the controller responsible for personal information collected through this website.

Information you provide. When you submit a project enquiry, we collect your name, company name, email address, the area you want to improve and the details you provide about your business problem. Budget and timeframe information is optional.

Technical information. Our hosting and security providers may process IP address, browser and device information, request times, referring pages and security logs to deliver and protect the website.

Please do not include special-category or highly sensitive personal information in the enquiry form unless Code Noir has specifically asked you to provide it.

To assess and respond to enquiries. We rely on steps taken at your request before entering a contract and, where appropriate, our legitimate interest in communicating with prospective clients.

To operate and protect the website. We rely on our legitimate interests in maintaining a secure, reliable website, preventing misuse and understanding technical faults.

To maintain required records. We may process information where necessary to comply with legal obligations or establish, exercise or defend legal claims.

We do not use enquiry information for unrelated marketing, sell personal information or make decisions about people using solely automated processing.

Code Noir uses service providers only where needed to operate the website and respond to enquiries. These include Formspree, Inc., which receives and delivers project-form submissions, and hosting and security infrastructure that uses Cloudflare services to deliver and protect the website.

Information may also be disclosed to professional advisers or public authorities when reasonably necessary or required by law. We do not sell or rent personal information.

Some service providers may process information outside the United Kingdom. Formspree states that it uses infrastructure in the United States and may process information in other countries where it operates.

Where UK data-protection law requires it, Code Noir relies on safeguards made available through the relevant provider, such as UK adequacy regulations or approved contractual protections. You may contact us for more information about the safeguards relevant to your information.

Unsuccessful or inactive project enquiries are retained for no longer than 12 months after the last meaningful contact, then deleted or anonymised unless there is a legal reason to keep them longer.

If an enquiry becomes a client relationship, relevant information forms part of the client record and is retained for the duration of the relationship and afterwards only as needed for contractual, tax, accounting, legal or dispute-resolution purposes. Technical and security logs follow the limited retention periods set by the relevant hosting or security provider.

This website currently uses only the essential technologies described below. It does not use analytics, advertising, behavioural profiling or cross-site tracking cookies.

Essential technologies do not require consent under the applicable storage-and-access rules. The website therefore provides an acknowledgement notice rather than asking for consent to optional technologies that are not present. If analytics, advertising or another non-essential technology is introduced, it will remain disabled until the required choice has been obtained.

Depending on the circumstances, UK data-protection law may give you rights to access, correct or erase your personal information; restrict its use; object to processing based on legitimate interests; and receive certain information in a portable form.

Your right to object: you may object to processing based on legitimate interests. We will stop unless we can demonstrate compelling legitimate grounds or the processing is needed for legal claims.
